HOW is not a mystery. Politicians have been playing the lawfare game forever. Opposition research coupled with nuisance lawsuits are a great way to distract the opponent and force him to make stupid moves. Both sides know HOW to play the game.
In this specific case WHY is the mystery. Repooflicans tried lawfare against Hillary and failed. Dems tried it against Trump and failed spectacularly. Every trivial prosecution for ordinary NYC hobbies like tax evasion and blackmail caused more support for Trump. Prosecuting him for keeping classified documents was itself a crime, since presidents have full authority to handle secret stuff and declassify it. More broadly, executives NEED to know secrets that are hidden from subordinates. If they feel restrained by fear of lawsuits, they might make decisions with poor information.
The trend was instantly clear. Every legal trick gained more support for Trump. Why did the Dems continue a transparently LOSING strategy?
